What to Do If You Have Been Charged with Probation Violation

probation violationIf you have been convicted of a crime and are on probation, the last thing you want is to wind up back in court.  Unfortunately, probation violations are common and can arise from a variety of technical violations.  When sentenced, your probation will have a predetermined length and if, at any point during that probation, you are found to be in violation, you could face additional charges or an extension of your probation.  If you have been charged with probation violation, hire an attorney right away because probation court operates very differently from typical criminal court.

How Probation Court is Different From Criminal Court

Probation court is unique because you have already been convicted of a crime and you are not entitled to the same level of protections that a typical citizen would be given. In fact, in a criminal court the prosecutor would have to prove that you are guilty beyond a reasonable doubt but in probation court all that must be proved is a preponderance of evidence which is much easier to prove.  Probation violations can arise for a variety of seemingly “minor” things and before you know it, you are in court for probation violation.  While the reasons may seem minor, it is important to understand that, in the State of Arizona, probation violations are taken very seriously.  Often, a judge will simply sentence you for probation violation unless you present a very strong defense which the average person cannot do.
